Privacy Policy of Proactive Therapy Services
Policy Statement
Proactive Therapy Services and Frances Anne Robinson Professional Corporation (Proactive) recognize and respect an individual’s right to privacy. We are committed to collecting, using and disclosing personal information in a responsible manner in accordance with the law. Proactive also recognizes the important principles for the protection of personal information in respect of commercial activity, as set out in the Personal Information Protection and Electronic Documents Act (“PIPEDA”).
What Constitutes Personal Information?
Personal information is any information about an identifiable individual, but does not include the name, title, business address or telephone number of an employee of an organization.
Personal Information Collection
Proactive collects personal information about our clients, so we can provide occupational therapy services that they require. While such information is usually collected directly from our clients, it may also be collected from other sources such as insurance companies, governmental agencies and other medical practitioners.
Collection / Use / Disclosure of Personal Information
Personal information, as defined above, is used as part of our treatment and therapy programs. It is necessary, for instance, to obtain medical records in order to determine the most appropriate treatment and therapy for our clients. In order to allow us to access medical records, we may require a Social Insurance Number and/or Medicare number or other such identifying information. In order to communicate with an insurance company, we require certain insurance information from our clients which may facilitate insurance coverage of treatment and therapy with us. Occasionally, some of our clients participate in Federal and Provincial programs which also require disclosure of information. This information is used to communicate with the respective levels of governments necessary to allow participation in these various programs.
Not all of our clients will be required to supply all of this personal information, and the staff of Proactive will limit collection of personal information to that which is strictly required for the purposes of our specific treatment or therapy program.
Consent and Exceptions to Obtaining Consent
Proactive recognizes the importance of obtaining consent where required by law for collection, use and disclosure of personal information. For the purposes of obtaining an individual’s consent, Proactive shall consider the following principles and exceptions, as permitted by PIPEDA:
• consent may be express or implied, depending on the circumstances; express consent should generally be obtained when information is likely to be considered sensitive;
• to be meaningful, the individual shall be notified of the purposes for which the personal information will be used or disclosed at or before the time of collection;
• when personal information that has already been collected is to be used for a new purpose, the additional consent of the individual to use or disclose for that new purpose shall be obtained;
• consent may be given orally when information is collected over the telephone;
• consent may be given at the time that individuals use the services of Proactive; and
• subject to contractual restrictions and reasonable notice, an individual may withdraw consent at any time.
Retention
Any personal information that we collect shall be retained as long as is necessary to fulfil the purpose for which the information was collected, and as required to satisfy any potential legal obligations that Proactive may have in respect of the information.
Safeguards for Personal Information
Proactive shall take appropriate physical, organizational and technological measures in order to safeguard all personal information under our control. The nature of the security measures we employ will vary depending on the amount, distribution, format, method of storage and, above all else, the sensitivity of the information that has been collected.
Openness
Subject to any legal or contractual restrictions or restrictions imposed by the therapy and treatment program in which she or he is involved, an individual whose personal information is under our control shall, upon request, be informed of the existence, use and disclosure of her / his personal information and shall be given access to that information. She or he may be able to challenge the accuracy and completeness of the information and have it amended as reasonably required. Furthermore, Proactive shall make available a copy of this policy and any other information relating to our management of personal information that we deem appropriate for distribution. Any inquiries from individuals about personal information collected, used or disclosed by Proactive shall be directed to our Privacy Officer identified below.
